This consent form describes important matters with regards to the DNA Paternity/Maternity test services offered by the Company.
[ Terms and Conditions ]
<About the DNA Test Service>
- 1. The purpose of this DNA Paternity/Maternity test service is to provide genetic information of the participants based on the DNA extracted from the samples collected by the participants themselves (for non-legal DNA testing) or obtained by our collector (for legal DNA testing) and to determine the biological relationship indicated in the DNA test type.
- 2. The Company shall not accept any applications under false names or are anonymous.
- 3. Minors cannot apply for the DNA test service. However, if the minor enters a legal marriage and an official certification is presented, the application will be accepted.
- 4. Before availing this service, the applicant must obtain the consent of all the participants in the test. If the participant is a minor, the consent must be given and signed by the parent or legal guardian.
- 5. The applicant must strictly comply with the terms and conditions outlined in numbers 2, 3, and 4. In the case that any falsification of identity and/or documents has been made, the applicant must take full responsibility.
- 6. For legal DNA testing, it is required that our collector obtain the DNA samples directly from the participants. Our collector verifies the identity of the participants through qualified ID showing the participant’s face (e.g., driver’s license, passport) before the collection of DNA samples. In the case the participants cannot provide the required qualified ID, the participants must submit two qualified IDs issued by public institutions (e.g., family register, health insurance card). Our Company requires that the collector, who is a third party, must verify the identity of all the participants. Thus, the DNA test results and analysis report can be used for evidentiary purposes in court. However, it does not guarantee any decision that the court will make.
- 7. For non-legal DNA testing, the DNA samples may be collected by the participants themselves and not verified by our collector. In this case, the DNA test results and
analysis report are not admissible in court. If a DNA test for legal purposes is required, the applicant must apply for a legal DNA test.
- 8. The applicant is responsible for checking the validity of the DNA test analysis report prepared from this service as admissible evidence in the judicial system or the
embassy/immigration of the countries/cities where the applicant and/or participants live (for legal DNA testing).
- 9. In the case of incomplete information on both the application form and DNA sample envelopes submitted by the applicant, the Company shall reserve the right to
correct, add, or erase any information deemed necessary for a more efficient DNA test service and analysis report. The final DNA test analysis report shall be based
on the information provided by the applicant. Therefore, the Company shall not accept any modifications or changes once the analysis report is released and will not
assume any responsibility for any incorrect information. Thus, please fill in the application form and DNA sample envelopes clearly and carefully.
- 10. For non-legal DNA testing, the Company shall not be responsible for the condition of the samples submitted by the applicant before their arrival in the laboratory. In
the case of improper DNA sample collection, it is anticipated that there will be instances where the results cannot be obtained.
- 11. The period within which the DNA test analysis is completed and the date on which the analysis report is released may be shortened or extended depending on the
condition of the sample.
- 12. While the procedures undertaken are appropriate and correct, nevertheless, there are instances that the test results cannot be obtained due to genetic mutation, defect,
and other scientific factors.
- 13. If the DNA samples submitted by the participants are insufficient for testing, a recollection shall be requested once without charge. However, in the case that the
participants fail to provide the samples or cease communication within thirty (30) days, the test will be cancelled. Regarding expenses, please contact the Company
as they may be subject to change.
- 14. Personal information of the applicant and participants and data of DNA test results will be preserved for six (6) months for non-legal testing and one (1) year for legal
testing, and will automatically be deleted in the Company’s system after this period.
- 15. Once the personal information of the applicant and participants and data of DNA test results are deleted after the period stated in number 14, the Company will not
respond to any inquiries or requests with regards to the DNA test. Moreover, personal genetic information may be used by the Company as anonymous data for
research.
- 16. The numerical values used in the DNA test analysis report are obtained based on genetic sequences and calculated through statistical methods.
- 17. The DNA test results might be different from what the applicant and participants expect, which might affect the family and the relationship between and among its
members. Thus, please be careful when applying for the test.
< Application and Cancellation >
- 1. Once payment for the services has been settled and the completed application forms and DNA samples have been retruned, the DNA test will officially be processed.
If payment is not confirmed or required information is missing, the test will not proceed.
- 2. DNA test kits may be returned/refunded only if the kit has not been opened and the request is done within eight (8) days from the date of purchase. The Company shall
not allow the return/refund of DNA test kits that have already been opened. If a defect in the DNA test kit has been confirmed, the Company shall replace it with a new
one. The shipping cost required for this will be shouldered by the Company. Shipping fee from the applicant may be substituted by a stamp.
- 3. The cancellation of the DNA test service without any cancellation fee is only allowed before the payment has been confirmed. However, once the payment has been
confirmed, the Company shall charge a cancellation fee as detailed below:
- 1. If a business trip has been scheduled for the collection of samples and the cancellation of the DNA test service is done eight (8) days or more before the scheduled
trip, the cancellation fee shall be 20% of the inspection kit cost (excluding miscellaneous fees).
- 2. If a business trip has been scheduled for the collection of samples and the cancellation of the DNA test service is done seven (7) days before the scheduled trip,
the cancellation fee shall be 20% of the DNA test service cost cost (excluding miscellaneous fees).
- 3. If a business trip has been scheduled for the collection of samples and the cancellation of the DNA test service is done three (3) days before the scheduled trip,
the cancellation fee shall be 30% of the DNA test service cost (excluding miscellaneous fees).
- 4. If a business trip has been scheduled for the collection of samples and the cancellation of the DNA test service is done one (1) day before the scheduled trip, the
cancellation fee shall be 60% of the DNA test service cost (excluding miscellaneous fees).
- 5. If a business trip has been scheduled for the collection of samples and the cancellation of the DNA test service is done on the actual day of the scheduled trip, the
cancellation fee shall be 100% of the DNA test service fee (excluding miscellaneous fees).
- 6. Please note that other miscellaneous fees (e.g., transportation costs, hotel room downpayments) stated in conditions ② to ⑤ that the Company is not able to
refund shall be shouldered by the applicant.
- 4. The Company shall not accept the cancellation of service once the DNA test analysis has started. Moreover, no refunds shall be allowed unless an error in the analysis
has been confirmed.
- 5. If the DNA test is performed using the DNA samples submitted by the applicant, a refund of the DNA test service fee shall not be allowed regardless of the time required for the analyis or the DNA test results obtained.
- 6. The DNA test service offered herein is only available in Japan. Please contact the Company in regards to applications and samples coming from overseas.
<Handling of Personal Information>
- 1. The Company shall not respond to any inquiries from anyone other than the applicant with regards to the contents of the DNA test. The Company shall ask for the
following to confirm the identity of the applicant: ① case number, ② complete name, ③ birth date, ④ address, and ⑤ telephone number. However, even if the identity
of the applicant is confirmed, the Company shall not disclose the results of the test analysis and any personal genetic information of the participants.
- 2. The personal information of the applicant and participants and subsequent personal genetic information shall be used solely for the purpose of the DNA test service.
Under no circumstances will any information be disclosed to others, unless otherwise compelled by law.
- 3. Personal information provided in this DNA test service will be handled in compliance with the Ministry of Economy, Trade and Industry's (METI) guidelines for personal
genetic information protection.
- 3. The court in Shinjuku-ku, Tokyo, Japan (district court/summary court) shall have exclusive jurisdiction over any dispute to the Company arising from this DNA test
service.

<Exemption Clause>
The applicant holds the Company free and assures no liability arising from any dispute between and among the applicant/participants in the test conducted. The
Company shall not be liable for any damages that will be caused by the results to anyone, be a participant in the test or not.
